Austin police investigate officer-involved shooting resulting in one fatality

The Austin Police Department (APD) is investigating an officer-involved shooting that took place on September 10, 2024. APD has reiterated its commitment to transparency and accountability by releasing information about the incident within ten business days, in line with its policy.

The department is working with the Office of Police Oversight and the City of Austin to release relevant audio and video materials from the investigation. The Travis County District Attorney's Office has reviewed these materials for public release. The details shared are preliminary as the investigation is still in its early stages.

Five officers discharged their firearms during the incident. Additionally, Officer Jeremmy Santos deployed a pepperball launcher. All six officers involved have been placed on administrative leave per APD protocol.

The incident began when Austin 9-1-1 received a call at approximately 10:59 p.m. reporting a prowler at 1724 West Anderson Lane. The caller reported that Franklin Earl Miller was attempting to break into her business while holding a rock and possibly carrying a gun in his waistband. Officers were dispatched within two minutes.

Upon arrival at approximately 11:11 p.m., officers encountered Mr. Miller, who did not comply with their commands. He appeared to be holding an object resembling a pistol near his waistband. Despite repeated commands from officers, Mr. Miller continued making sudden movements and gripping what appeared to be a pistol.

At around 11:25 p.m., after multiple attempts to gain compliance, Mr. Miller raised his firearm towards the officers, prompting them to discharge their weapons. Life-saving measures were immediately initiated by the officers until Austin-Travis County Emergency Medical Services arrived at approximately 11:30 p.m., pronouncing Mr. Miller deceased three minutes later.

No injuries were reported among officers or other members of the public during this incident, which remains under active investigation without any charges currently pending.

The entire event was captured on body-worn cameras worn by multiple officers present at the scene. While such footage does not capture every detail experienced by those involved, it provides significant insight into what occurred.
